If your sale is over $500.00 and involves a home improvement as defined by N.J.A.C. 13:45A- 17.2 and N.J.S.A. 56:8-137, you are being provided with the following notice:
NOTICE TO CONSUMER
YOU MAY CANCEL THIS CONTRACT AT ANY TIME BEFORE MIDNIGHT OF THE THIRD BUSINESS DAY AFTER RECEIVING A COPY OF THIS CONTRACT. IF YOU WISH TO CANCEL THIS CONTRACT, YOU MUST EITHER:
1)SEND A SIGNED AND DATED WRITTEN NOTICE OF CANCELLATION BY CERTIFIED MAIL, RETURN RECEIPT REQUESTED OR
2) PERSONALLY, DELIVER A SIGNED AND DATED WRITTEN NOTICE OF CANCELLATION TO CENTRAL JERSEY POOL & SUPPLY CO. INC. 4235 ROUTE 9 NORTH FREEHOLD, NJ 07728. OUR PHONE NUMBER IS 732-462-5005, OUR FAX IS 732-462-0438 AND OUR EMAIL IS INFO@CENTRALJERSEYPOOLS.COM
If you cancel this contract within the three-day period, you are entitled to a full refund of your money. Refunds must be made within 30 days of the contractor's receipt of the cancellation notice.
Any changes to this contract must be in writing, signed by you and Central Jersey Pools and is subject to the cancellation provisions above if applicable.
Attached to this contract should be a certificate of our insurance. If it is not, you may print one at www.centraljerseypools.com/insurance. The telephone number for the insurance company is 732-747-0800.
If your purchase involves installation or services, it is estimated that the work will commence on _______ and will be completed on or around _________. This time period is subject to change depending on weather conditions, product or material availability and other factors beyond our control. Delays beyond Central Jersey Pools control may delay start and completion times.
Delays in delivering product or service beyond Central Jersey Pools estimated due beyond Central Jersey Pools control is not a valid reason for cancellation or refund. You agree to wait until your product or service arrives no matter how long it takes to come in. If you cancel your contract, you agree to forfeit your deposit without dispute.
EXCEPT TO THE EXTENT OTHERWISE PROHIBITED BY LAW, ANY AND ALL DISPUTES, CONTROVERSIES OR CLAIMS ARISING OUT OF OR RELATING TO THIS OR THE PRODUCTS OR SERVICES RENDERED BY THE COMPANY SHALL EXCLUSIVELY BE SUBMITTED TO AND DETERMINED BY FINAL AND BINDING ARBITRATION. THIS INCLUDES ALL DISPUTES THAT ARISE BETWEEN AND AMONG THE CUSTOMER WHETHER ARISING UNDER THE COMMON LAW OR ANY FEDERAL, STATE OR LOCAL STATUTE INCLUDING ALL STATUTORY CLAIMS ARISING OUT OF THE RELATIONSHIP AND ANY CLAIM OR DISPUTE BASED ON A FEDERAL OR STATE STATUTE. CUSTOMER KNOWINGLY AND VOLUNTARILY AGREES AND ACKNOWLEDGES THAT S/HE IS WAIVING ANY RIGHTS TO BRING SUCH CLAIMS IN COURT AND IS WAIVING ANY RIGHTS TO A JURY TRIAL IN ANY ACTION OR PROCEEDING RELATED TO THIS AGREEMENT. FURTHER, YOU WILL NOT HAVE THE RIGHT TO PARTICIPATE AS A REPRESENTATIVE OR MEMBER OF ANY CLASS OR CLAIMANTS PERTAINING TO ANY CLAIM AND OTHER RIGHTS THAT YOU MAY HAVE IF YOU WENT TO COURT MAY NOT BE AVAILABLE IN ARBITRATION.
The product is provided "as is" and with all faults. Central Jersey Pools does not provide additional warranties of any kind whatsoever. All warranties are only through the manufacturer. Customer agrees to waive all claims against Central Jersey Pools and its representatives arising or resulting from the use of the product. Central Jersey Pools will act as a warranty station to serve our customers where allowed by the manufacturers. All manufactures warranties are available for review upon request.
If you fail to pay for your purchase after delivery by any means including but not limited to insufficient funds, stop payment or credit card chargeback, you agree to pay all collection costs including legal fees to collect any amounts owed plus court costs and the maximum interest allowed by law. Purchasing an item, keeping it and not paying for it is a criminal offense and, in some cases, Central Jersey Pools will protect their rights by pursuing a criminal complaint.
All purchases are subject to Central Jersey Pools management approval & Central Jersey Pools refund policy which starts with customer deposit, not receipt of good. You agree that no verbal commitments have been made other than what is written on this invoice. Upon delivery this sale is considered complete and in acceptable condition unless noted on delivery receipt. If you are given any other companies' referrals, please understand they are independent contractors, and you are free to use them or any other company. CJP is not responsible for their work. We do not accept payments on delivery.
Credit card payments can be made in person at Central Jersey Pools Credit card payments can be made online for an additional fee. No credit card payments over the phone or without the card present.
Personal check payments must be made 3 days before delivery. Cash & bank checks can be made same day but must be made at the store before product leaves for delivery.
The deposit of $500 (Stock items) 50% for special orders is non-refundable after the 3rd day of date signed.
If you receive a refund of a payment made on a credit card you agree to pay / deduct a 4% processing fee.
You agree to accept delivery of your product within 3 weeks of our receiving it regardless of timing. We cannot store the product over the winter or extended time without a monthly storage charge of $99 a month.
